Summary
Iqamah is a tool that displays prayer times, Hijri dates, and worship reminders. It is not a religious authority. Times are calculated from published astronomical methods and your location, and they can differ from your local mosque. Use it as a convenience, and rely on your mosque or a scholar for religious rulings.
This summary is provided for readability. The numbered sections below are the terms that apply.
1. Who You Are Contracting With
Iqamah is published by StacknScope ("StacknScope", "we", "us"). These terms form an agreement between you and StacknScope covering your use of the app.
Purchases made through this website are processed by Stripe, which acts as the merchant of record and is the seller for that transaction. Stripe's own terms govern payment, tax, and billing. Purchases made through the Mac App Store are governed by Apple's terms. Nothing in these terms replaces the terms of whichever party sold you the licence.
2. Licence
Iqamah Pro is a one-time purchase, not a subscription. Subject to these terms, we grant you a personal, non-exclusive, non-transferable licence to install and use Iqamah Pro on up to three Macs that you own or control, for as long as the licence remains active.
You may deactivate a Mac at any time from the licence page linked in your purchase email, which frees the activation for another machine.
You may not sell, sublicense, rent, share, or publish your licence key. You may not attempt to circumvent, disable, or reverse engineer the licensing system, except where that restriction is prohibited by law that cannot be waived by agreement.
3. Free Trial
The seven-day free trial is offered once per person and requires a verified email address. We may decline to issue a trial, or end one, where we reasonably believe it is being used to obtain repeated free access.
4. Refunds and Revocation
Our refund terms are set out on the Refunds page and form part of these terms. Where a purchase is refunded, charged back, or disputed, the associated licence is revoked and Pro features stop working on every Mac it was activated on.
5. Updates
The direct edition checks for updates and can install them. We may change, add, or remove features in an update. We do not promise that any particular feature will remain available indefinitely, and we may discontinue Iqamah entirely. Where we discontinue it, previously issued licences continue to work on installed versions for as long as they function, but we do not undertake to keep the licensing service running indefinitely.
6. Prayer Times Are Calculated, Not Authoritative
Prayer times, qibla direction, Hijri dates, and calendar events shown in Iqamah are calculated from astronomical formulas, the calculation method you select, your device clock, and your location. They are approximations. They can and do differ from times observed by your local mosque, from official announcements, and from moon-sighting determinations.
Iqamah must not be relied on as the sole basis for religious observance. We make no representation that any time, date, or direction shown is correct for your location, your school of jurisprudence, or your local authority.
7. No Warranty
Iqamah is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
We do not warrant that Iqamah will be uninterrupted, timely, secure, or error-free, that notifications or alerts will be delivered or delivered on time, that calculated times will be accurate, or that defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by law, StacknScope will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to Iqamah or these terms, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Iqamah or these terms will not exceed the greater of (a) the amount you actually paid us for Iqamah in the twelve months preceding the event giving rise to the claim, or (b) five United States dollars (USD 5.00).
This includes, without limitation, any claim arising from a missed, late, early, or incorrect prayer time or notification.
9. Indemnification
You agree to indemnify, defend, and hold harmless StacknScope and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable legal fees and costs of defence) arising out of or relating to:
- your use or misuse of Iqamah, including any reliance placed on times, dates, directions, or reminders it displays;
- your breach of these terms or of any applicable law;
- your infringement or misappropriation of any right of a third party; or
- any content, data, or instruction you supply to or through the app.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence of that claim. You will not settle any matter that imposes any obligation or admission on us without our prior written consent.
This section survives termination or expiry of these terms and of your licence.
10. Your Statutory Rights
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under any non-excludable statutory guarantee.
If you are a consumer, you may have rights under the consumer law of your country that these terms cannot override, and those rights apply in addition to the terms above. Where a provision of these terms conflicts with a mandatory consumer protection to which you are entitled, that protection prevails to the extent of the conflict and the remainder of these terms continues to apply.
11. Suspension and Termination
We may suspend or revoke a licence where a purchase is refunded, charged back, or disputed, where a licence key is shared or published, or where we reasonably believe the licensing system is being circumvented. Where the circumstances allow, we will contact you first.
You may stop using Iqamah at any time. Sections 6 to 10, 12, and 13 survive termination.
12. Changes to These Terms
We may update these terms. The effective date at the top of this page shows when they last changed. Changes are not retroactive: the version in force when you bought a licence governs that purchase, except where a change is required by law.
13. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of law rules. The courts of Ontario have non-exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings there where that law entitles you to.
14. Severability and Entire Agreement
If any provision of these terms is held unenforceable, it is to be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it.
These terms, together with the Privacy Policy and the Refunds page, are the entire agreement between you and StacknScope regarding Iqamah.
